The rules that apply when you access and use Echory.
These Terms of Service ("Terms") are a binding agreement between you and Echory ("Echory", "we", "us") governing your access to and use of the Echory website, applications, and services (together, the "Service").
By creating an account, uploading a book, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.
You must be at least 16 years old (or the age of digital consent in your country, if higher) to use Echory.
You must provide accurate account information and keep your login credentials secure. You are responsible for all activity that occurs under your account.
You may not share access in a way that bypasses account, subscription, or usage limits, and you must notify us promptly of any unauthorized use of your account.
Echory converts books you upload (such as EPUB and PDF files) into spoken-audio versions using automated text extraction and text-to-speech ("TTS") technology, so you can listen to them.
Automated extraction, chapter detection, and narration are not perfect. Output may contain errors, omissions, mispronunciations, or formatting artifacts, and is provided for your personal listening convenience — not as an authoritative or verbatim reproduction of the original work.
You retain ownership of the books, text, and other materials you upload ("Your Content"). You grant Echory a limited, non-exclusive, worldwide license to host, store, reproduce, adapt, transform, and transmit Your Content solely as necessary to operate and provide the Service to you.
You represent and warrant that you own Your Content or have all rights, licenses, and permissions necessary to upload it and to have it converted to audio for your personal use. You are solely responsible for ensuring your use complies with copyright and other laws.
Echory is a personal tool for content you are entitled to use. Do not upload material you do not have the right to use, and do not use the Service to reproduce, distribute, or publicly perform works in a way that infringes the rights of others.
We respect intellectual property rights and respond to valid notices of alleged infringement. If you believe content on Echory infringes your copyright, send a notice to copyright@echory.app including: your contact information; identification of the work; identification of the allegedly infringing material and where it is located; a statement of good-faith belief that the use is not authorized; a statement that the information is accurate and, under penalty of perjury, that you are authorized to act; and your signature.
We may remove content and, in appropriate circumstances, suspend or terminate accounts of users who repeatedly infringe.
To provide the Service, Your Content and related data may be processed by trusted third-party providers — including cloud hosting, database, storage, AI/TTS, and our payment processor Stripe, Inc. — acting on our behalf. See our Privacy Policy for the categories of providers we use.
We instruct our providers to process your data only to deliver the Service. We do not sell Your Content, and we do not use Your Content to train third-party foundation models except as needed to generate your audio.
Echory offers a free tier and paid "Premium" plans. Paid plans are billed in advance on a recurring basis (monthly or yearly) through our payment processor, Stripe, Inc. Your card details are handled by Stripe and are never stored by Echory. By subscribing, you authorize us to charge your payment method for each renewal until you cancel.
Subscriptions renew automatically at the then-current price unless you cancel before the renewal date. You can cancel anytime from your account; cancellation takes effect at the end of the current billing period, and you keep Premium access until then.
Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods, unused time, or usage limits. We may change plan features and pricing prospectively; material changes to recurring pricing will be communicated before they take effect.
Every plan includes stated monthly allowances rather than unlimited use, because converting and narrating a book has a real per-use cost. As of the date above: the Free tier includes 1 book and 100 listening minutes per month (20 minutes per day). Premium — monthly or annual — includes 10 books and 500 listening minutes per month (120 minutes per day). "Books" counts documents you convert in a billing month; "listening minutes" counts audio you play.
When you reach an allowance, conversion or playback pauses until your allowance resets at the start of your next billing month. Unused allowance does not roll over, and allowances are per account, not per device.
We may adjust these allowances. If we reduce an allowance on a paid plan, we will tell you before the change takes effect and you may cancel for the remainder of your term. We may also apply reasonable measures against use that is automated, resold, shared across multiple people, or otherwise inconsistent with personal use.
You may not use Echory to violate the law, infringe intellectual property or privacy rights, upload malware, distribute harmful, hateful, or illegal material, interfere with system security, or attempt to access data or accounts that are not yours.
You may not reverse engineer, decompile, scrape, resell, or abuse the Service, circumvent usage limits or access controls, or use automated means to overload or disrupt the Service.
Echory and its software, design, user interface, branding, and related materials are owned by Echory and protected by intellectual property laws. These Terms do not grant you any rights in Echory’s brand or technology except the limited right to use the Service.
If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that extraction, chapter detection, or narration will be accurate or complete.
To the maximum extent permitted by law, Echory and its providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or US $50.
You agree to indemnify and hold harmless Echory from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or the rights of any third party.
You may stop using Echory and delete your account at any time. On deletion, we remove or de-identify your data as described in our Privacy Policy.
We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for the Service, or use the platform fraudulently or abusively. Provisions that by their nature should survive termination (including content ownership, disclaimers, limitation of liability, and indemnification) will survive.
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to arbitration or small-claims court, to the extent permitted by applicable law.
Nothing in these Terms limits any consumer-protection rights that cannot be waived under the law of your country of residence.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and Echory regarding the Service.
